1. Background
TheInterim Measures for the Management of Generative Artificial Intelligence Services were jointly formulated by the Cyberspace Administration of China, the National Development and Reform Commission, the Ministry of Education, the Ministry of Science and Technology, the Ministry of Industry and Information Technology, the Ministry of Public Security, and the State Administration of Radio, Film and Television, and were issued on July 13, 2023, and will come into force on August 15, 2023. The legislative basis includes the Cybersecurity Law, Data Security Law, Personal Information Protection Law, and Science and Technology Progress Law, aiming to regulate generative AI service activities and promote its healthy development.
II. Scope of Application
These Measures apply to activities that use generative artificial intelligence technology to provide text, picture, audio, video and other content generation services to the public in China. Scientific research institutions, industry organizations, and internal applications that are not open to the public are not subject to application.
3. Basic principles
Adhere to the combination of development and security, promote innovation and governance according to law, and implement inclusive and prudent and classified and hierarchical management, which not only supports technological progress and application innovation, but also prevents legal, ethical and security risks.
4. Main provisions
- Content specifications: The generated content must comply with laws and regulations and the core socialist values, and it is prohibited to produce, publish, or disseminate illegal information, including inciting subversion of state power, violent terrorism, ethnic discrimination, obscenity, pornography, false information, etc.
- Data and model management: Training data should be from legal sources to ensure authenticity, accuracy, and diversity. Quality control of data annotation is required.
- Protection of user rights and interests: Protect personal information and privacy to prevent minors from becoming addicted; Implement prominent identification of synthetic content, such as adding a watermark.
- Service specifications: Providers need to sign service agreements, establish complaint and report channels and handle them in a timely manner; Measures such as stopping the generation and dissemination of illegal content and optimizing the model should be immediately taken, and reported to the competent department.
- Security and Filing Requirements: Algorithms involved in generative AI services should fulfill security assessment and filing obligations and be subject to multi-departmental supervision.
V. Supervision and Legal Responsibility
The Cyberspace Administration of China and relevant competent departments shall be responsible for supervision, and those who violate these Measures will be investigated for legal responsibility in accordance with law, including ordering rectification, suspension of services, fines, etc.
